This Privacy Policy describes how Pensive Beauty, LLC (“we,” “our,” or “the Company”) collects, uses, and protects information across pensivebeauty.com and all associated services, including the NanoBase™ AI Chemist formulation tool (collectively, “the Services”). By using any of our Services, you agree to the practices described in this policy.

We do not sell, rent, or share your personal information or formulation data with third parties. Information you submit is used exclusively to deliver the services you requested and to facilitate collaboration if you choose to move forward with Pensive Beauty, LLC.

1. Information We Collect

1.1 Information You Provide Directly

When you interact with our Services, you may provide the following:

•       Contact information: name, email address, company name, phone number, mailing address

•       Order and project data: purchase history, project scope details, formulation preferences

•       User uploads: documents, images, formulation briefs, or other files submitted through our website or email

•       Meeting participation: information shared during virtual consultations booked through our scheduling system

•       Marketing preferences: newsletter subscriptions and communication opt-ins

1.2 Information Collected Through the NanoBase™ AI Chemist

When you submit a formulation request through our NanoBase™ AI Chemist tool at pensivebeauty.com/chemist, we collect:

•       Your name, company name, and email address

•       Your selected product type and NanoBase™ model preference

•       Your product description, including any ingredient requests, formulation goals, brand references, or technical questions (up to 5,000 characters)

•       Automatically generated routing metadata derived from your description, such as inferred submission type (new formula, reformulation, or product analysis), product category, and complexity estimate. This metadata is generated locally in your browser before submission and is used solely to route your request to the appropriate analysis workflow.

1.3 Information Collected Automatically

When you visit our website, we may automatically collect:

•       Device and browser information: IP address, browser type, operating system, screen resolution

•       Usage data: pages viewed, time spent, referring URLs, click patterns

•       Cookies and similar technologies (see Section 6 below)

•       Rate-limiting data: a temporary timestamp stored in your browser’s local storage to enforce our one-submission-per-day policy on the AI Chemist tool. This data is not transmitted to our servers and expires automatically after 24 hours.

2. How We Use Your Information

2.1 General Purposes

We use the information we collect to:

•       Fulfill your requests and deliver the services you requested

•       Respond to inquiries and provide customer support

•       Send project-related communications, such as your AI Chemist executive summary or follow-up consultation invitations

•       Communicate promotional offers (only if you have opted in)

•       Improve the functionality, security, and performance of our Services

•       Prevent fraud, abuse, and unauthorized access to our systems

•       Comply with legal obligations

2.2 NanoBase™ AI Chemist Processing

When you submit a formulation request through the AI Chemist, your data is processed as follows:

Submission and storage. Your submission is transmitted via encrypted HTTPS to our backend processing system and temporarily stored as a structured data file in a secured cloud environment while it awaits processing.

AI-assisted formulation analysis. Your submission, including your product description, ingredient requests, and selected product type is processed by an AI formulation engine. This engine operates a three-stage analysis protocol (architectural design, compliance audit, and narrative generation) to produce a complete formulation recommendation, executive summary, and lab procedure tailored to your request. The AI processes your submission data solely for the purpose of generating your deliverable; it does not learn from, retain, or reuse your submission for any other client’s analysis.

PDF generation and delivery. The output of the AI analysis is compiled into a branded executive summary PDF, which is delivered to the email address you provided. An internal copy of the PDF and a summary notification are sent to our formulation team to ensure we can assist you promptly if you decide to move forward.

Post-delivery deletion. Upon successful delivery of your executive summary email, your original formulation submission data is deleted from our processing queue. Your name and email address are retained solely so that our team can follow up regarding your project, should you wish to proceed with formulation services. You may request deletion of this retained contact information at any time (see Section 9).

Important: The AI Chemist is designed as a collaboration starting point. We retain minimal information after delivery specifically so we can work together effectively if you choose to engage our formulation services. We do not use your submission to generate formulations for other clients, and we do not share your formulation data with any external party.

3. Third-Party Service Providers

We use a limited number of trusted service providers to operate the Services. These providers process data on our behalf and are contractually prohibited from using your information for their own purposes:

•       NanoBase™ AI Chemist Email delivery: We use Postmark (Wildbit, LLC) to deliver transactional emails, including your AI Chemist executive summary. Postmark receives your email address and the PDF attachment for the sole purpose of email delivery.

•       Cloud storage: Submission data is temporarily stored in Google Drive during processing. Data is deleted from this storage after your executive summary is delivered.

•       AI processing: Formulation analysis is performed by an AI system that processes your submission to generate the executive summary. Per the API terms, submissions processed through the API are not used to train AI models.

•       Website hosting: Our website is hosting may collect standard analytics data in accordance with their privacy policy.

•       Payment processing: If applicable, payments are processed by third-party payment processors. We never store full credit card numbers on our servers.

We do not sell your data. We do not permit any service provider to use your information for advertising, profiling, or any purpose beyond delivering our Services to you.

5. Data Security

We implement reasonable technical and organizational safeguards to protect your information, including:

•       Encrypted transmission (HTTPS/TLS) for all data submitted through our website and APIs

•       Token-based authentication separating public submission endpoints from internal administrative functions

•       Automated abuse detection to identify and block submissions that attempt to extract proprietary information

•       Restricted access to client data on a need-to-know basis within our team

No method of electronic transmission or storage is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.

6. Cookies and Tracking Technologies

Our website uses cookies and similar technologies to operate features, understand user interaction, and customize content. Specifically:

•       Functional cookies: If you leave a comment, you may opt in to saving your name, email, and website in cookies for convenience (duration: 1 year).

•       Session cookies: Temporary cookies to determine browser compatibility and manage login sessions (duration: session to 2 weeks, depending on your preferences).

•       Analytics: We may use first-party or third-party analytics tools to understand how visitors use our website. This data is aggregated and does not identify individual users.

•       Rate-limiting: The AI Chemist stores a timestamp in your browser’s local storage (not a cookie) to enforce submission limits. This data never leaves your browser and expires after 24 hours.

You can disable cookies through your browser settings. Disabling cookies may limit some website functionality but will not affect your ability to use the AI Chemist tool.

7. Embedded Content and Third-Party Links

Our website may include embedded content from other websites (videos, images, articles). Embedded content behaves as if you visited the originating website, which may collect data, use cookies, and track your interaction. Our website may also contain links to external sites that are not governed by this policy. We encourage you to review the privacy policies of any third-party sites you visit.

8. Information Sharing

We do not sell, rent, or trade your personal information. We may share information only in the following limited circumstances:

•       With service providers who process data on our behalf to deliver the Services (as described in Section 3), subject to contractual obligations to protect your data

•       To comply with applicable laws, regulations, legal processes, or enforceable governmental requests

•       To protect the rights, property, or safety of Pensive Beauty, our users, or the public

•       Opt-out: Unsubscribe from marketing communications at any time by replying STOP to any SMS, clicking unsubscribe in any email, or contacting us directly

10. File Uploads and Media

IIf you upload images to our website, you should avoid uploading images with embedded location data (EXIF GPS). Visitors may be able to download and extract location data from images on the website.

By submitting any content, files, or media to Pensive Beauty, LLC through our website, email, or any other channel, you grant Pensive Beauty, LLC an irrevocable, perpetual, worldwide, royalty-free license to use such materials for commercial and operational purposes. You waive any claims for additional compensation related to such use.

11. SMS Messaging

By providing your mobile number and opting in, you consent to receive SMS messages from Pensive Beauty. These messages may include updates, promotions, appointment reminders, and other business-related communications.

•       No third-party marketing: We do not sell, rent, or share your mobile number with third parties for their marketing purposes.

•       Message frequency: Messages may be sent on a recurring basis as needed, primarily in response to your communications.

•       Opt-out: Reply STOP at any time to unsubscribe from future messages.

•       Help: Reply HELP for assistance or more information.

•       Message and data rates may apply, depending on your mobile carrier and plan.

Your consent to receive messages is not a condition of purchase.

12. Virtual Meetings and Recordings

If you participate in a virtual meeting or consultation with Pensive Beauty, LLC, the session may be recorded. By joining the meeting, you grant Pensive Beauty rights to use recordings for training, quality assurance, and internal purposes, unless you provide written objection prior to the meeting.

13. Children’s Privacy

Our Services are not intended for individuals under the age of 18. We do not knowingly collect information from children under 18. If we become aware that we have inadvertently collected such information, we will promptly delete it.

14. International Data Transfers

Pensive Beauty, LLC is based in the United States. If you access our Services from outside the U.S., your information may be transferred to, stored in, and processed in the United States, where data protection laws may differ from those in your jurisdiction. By using our Services, you consent to this transfer. Our third-party service providers (email delivery, cloud storage, AI processing) also operate servers in the United States.

Your continued use of the Services after any changes constitutes acceptance of the revised policy. For material changes, we will make reasonable efforts to notify you via email or a prominent notice on our website.
